(AP Photo/J. Scott Applewhite)

(AP) ? The White House and Senate Republicans sorted through stubborn disputes over taxing the wealthy and cutting the budget to pay for Democratic spending proposals as Monday's midnight deadline for an accord avoiding the "fiscal cliff" drew to within hours.

Senate Minority Leader Mitch McConnell, R-Ky., spoke repeatedly Sunday to Vice President Joe Biden, a former Senate colleague, in hopes of settling remaining differences and clinching a breakthrough that has evaded the two sides since President Barack Obama's November re-election. In one indication of the eleventh-hour activity, aides said the president, Biden and top administration bargainer Rob Nabors were all working late at the White House, and McConnell was making late-night phone calls as well.

Unless an agreement is reached and approved by Congress by the start of New Year's Day, more than $500 billion in 2013 tax increases will begin to take effect and $109 billion will be carved from defense and domestic programs. Though the tax hikes and budget cuts would be felt gradually, economists warn that if allowed to fully take hold, their combined impact ? the so-called fiscal cliff ? would rekindle a recession.

"There is still significant distance between the two sides, but negotiations continue," Senate Majority Leader Harry Reid, D-Nev., said shortly before the Senate ended an unusual Sunday session. "There is still time to reach an agreement, and we intend to continue negotiations."

The House and Senate planned to meet Monday, a rarity for New Year's Eve, in hopes of having a tentative agreement to consider. Yet despite the flurry of activity, there was still no final pact.

And in a move that was sure to irritate Republicans, Reid was planning ? absent a deal ? to force a Senate vote Monday on Obama's campaign-season proposal to continue expiring tax cuts for all but those with income exceeding $200,000 for individuals and $250,000 for couples.

Attached to the measure ? which the GOP seemed likely to block ? would be an extension of jobless benefits for around 2 million long-term unemployed people. The plan was described by Sen. Richard Durbin of Illinois, the chamber's No. 2 Democrat.

The House and Senate met Sunday ready to debate an agreement or at least show voters they were trying. But the day produced alternating bursts of progress and pitfalls, despite Senate chaplain Barry Black's opening prayer in which he asked the heavens, "Look with favor on our nation and save us from self-inflicted wounds."

In one sign of movement, Republicans dropped a demand to slow the growth of Social Security and other benefits by changing how those payments are increased each year to allow for inflation.

Obama had offered to include that change, despite opposition by many Democrats, as part of earlier, failed bargaining with House Speaker John Boehner, R-Ohio, over a larger deficit reduction agreement. But Democrats said they would never include the new inflation formula in the smaller deal now being sought to forestall wide-ranging tax boosts and budget cuts, and Republicans relented.

"It's just acknowledging the reality," Sen. Susan Collins, R-Maine, said of the GOP decision to drop the idea.

There was still no final agreement on the income level above which decade-old income tax cuts would be allowed to expire. While Obama has long insisted on letting the top 35 percent tax rate rise to 39.6 percent on earnings over $250,000, he'd agreed to boost that level to $400,000 in his talks with Boehner. GOP senators said they wanted the figure hoisted to at least that level.

Senators said disagreements remained over taxing large inherited estates. Republicans want the tax left at its current 35 percent, with the first $5.1 million excluded, while Democrats want the rate increased to 45 percent with a smaller exclusion.

The two sides were also apart on how to keep the alternative minimum tax from raising the tax bills of nearly 30 million middle-income families and how to extend tax breaks for research by business and other activities.

Republicans were insisting that budget cuts be found to pay for some of the spending proposals Democrats were pushing.

These included proposals to erase scheduled defense and domestic cuts exceeding $200 billion over the next two years and to extend unemployment benefits. Republicans complained that in effect, Democrats would pay for that spending with the tax boosts on the wealthy.

"We can't use tax increases on anyone to pay for more spending," said Sen. Kay Bailey Hutchison, R-Texas.

Both parties also want to block an immediate 27 percent cut in reimbursements to doctors who treat Medicare patients. Republicans wanted to find savings from Obama's health care bill as well as from Medicare providers, while Democrats want to protect the health care law from cuts.

Both sides agree that a temporary 2-percentage-point cut in the Social Security payroll tax was likely to expire. That reduction ? to 4.2 percent ? was initiated by Obama two years ago to help spur the economy and has meant $1,000 annual savings to families earning $50,000.

A senior defense official said if the spending cuts were triggered, the Pentagon would soon begin notifying its 800,000 civilian employees to expect furloughs ? mandatory unpaid leave, not layoffs. It would take time for the furloughs to be implemented, said the official, who requested anonymity because the official was not authorized to discuss the preparations

PopTrayU

One of the few utilities that I can't imagine living without is an e-mail notifier running in the Windows system tray, and the best I've found is a freeware open-source gem, PopTrayU. My main reason for wanting PopTrayU on my system is the obvious one?I want it to pop up a window that alerts me to new incoming mail. But I also want it for the less obvious, and slightly counter-intuitive reason, that it helps me to concentrate on my other work. With PopTrayU running in the system tray, and set to check new mail at regular intervals, I'm less tempted than I would otherwise be to open my mail client obsessively to see whether anyone has dropped me a line.

PopTrayU stands out from other mail notifiers with its clean, customizable design and complete keyboard support. Other notifiers tend to display either large, cluttered windows or tiny indicators with merely the number of new messages but no details. PopTrayU gives me the option of opening a tiny indicator or exactly what I want in a mail notifier, which is a compact window that lists the sender, subject, and time of each new message. If I click on one of the messages in the list, a preview window displays its contents, or I can right-click on the message and delete it or open my mail client and reply to it.

I like the way PopTrayU can be set up to list only new messages, not the hundreds of messages that I've accumulated in my inbox. I regularly check four or more accounts, and PopTrayU displays each on a separate tab, and lets me temporarily disable checking any account that I don't want distracting me.

Unlike every other mail notifier I've tried, PopTrayU lets me assign hotkeys to all its functions, so that, if I don't want to wait until the app performs its scheduled mail check, I can simply type Ctrl-Alt-C (or any other key-combination that I choose) and wait a few seconds while the app checks my mail. Of course I can also click on its tray icon, but keyboard is far more efficient and less distracting. An enormous range of options lets me specify periods when the app won't check mail, or exactly how many lines of a message to display in the preview window, or exactly how I want the program to notify me. A useful security option lets you password-protect the whole program against prying eyes.

PopTrayU is an update to a popular ten-year-old mail notifier called PopTray, originally written by Renier Crause, and now being updated by Jessica Brown with encouragement from the original author. The new version is currently in open beta, and still has a couple of rough edges that are scheduled to be smoothed out soon. For example, if you want to set up PopTrayU to check an account through the modern IMAP mail protocol, instead of the old-school POP protocol, you'll need to download and install the IMAP plug-in for PopTray from htttp://www.poptray.org/plugins.php. The new developer plans to integrate the app's plug-ins in a forthcoming beta version.

When you click Reply on PopTrayU's menus, the app launches your mail client, which is typically Thunderbird or Outlook. Even when I'm sending mail through web-based services like Gmail or Microsoft's new Outlook.com, I prefer to use a mail client, not the mail service's browser-based interface. But I'd like to see an option in PopTrayU that would let me click a message in its list of messages in my Gmail account and have my browser open Gmail's web interface. Maybe I'll get my wish in a feature version. Meanwhile, for anyone who uses a mail client, as I do, PopTrayU is an indispensable time-saver and distraction-reducer. Even as a work in progress, PopTrayU is better-designed than any of the dozen or more rival mail-checkers I've tried over the years.

Washington dodges the 'dairy cliff,' avoids spike in milk prices

The House's Agricultural Committee reached an agreement with the Senate to extend the US farm bill ?that will keep milk prices in check in 2013. Without the compromise the price of a gallon of milk may have reached $7.

By Jim Wolf,?Reuters / December 30, 2012

Jim Mitchell selects a gallon of milk at a Milwaukee grocery store Dec. 4. As the nation teeters on the brink of the economic ?fiscal cliff,? Washington has reached one compromise, extending the US farm bill, which if expired could have doubled the price of milk.

Farm-state lawmakers have agreed to a one-year extension of the expiring US farm bill that, if enacted, would head off a possible doubling of retail milk prices to $7 or more a gallon in 2013.

The compromise measure resulted from bipartisan discussions in the?House of Representatives' Agriculture Committee?and talks with colleagues in the US?Senate,?Frank Lucas?of?Oklahoma, the?House?panel's chairman, said in a statement Sunday.

"It is not perfect - no compromise ever is - but it is my sincere hope that it will pass the?House?and?Senate?and be signed by the President by January 1," Lucas, a Republican, said.

It was not immediately clear whether?House?and?Senate?leaders would bring the measure to a vote soon enough to avoid putting the so-called "dairy cliff" milk price spike into action.

Separately, lawmakers are working on a last-ditch effort to avert the similarly timed "fiscal cliff," when the biggest tax increases ever to hit Americans are set to start, paired with significant federal spending cuts

US Agriculture?Secretary?Tom Vilsack, in an interview with CNN taped Friday and aired on Sunday, urged?Congress?to come up with such a solution, if only an extension of the old law that expired nearly three months ago, lest milk prices start rising after Jan. 1, 2013.

Absent a new bill or an extension of current law, milk prices would revert to rules set in 1949, the last "permanent" farm legislation in the?United States. Government price supports would kick in, based on production costs 64 years ago, plus inflation. The potential retail milk price has been estimated at $6.00 to $8.00 a gallon versus current levels near $3.50.?

Lucas said in the statement that time had run out in?Congress' current session to enact a new five-year farm bill, as farm-state lawmakers and the dairy lobby had hoped.

Vilsack told CNN that soaring milk prices - if it comes to that - would ripple throughout all commodities "if this thing goes on for an extended period of time."

The price of milk will not double on Jan. 1, if?Congress?fails to act. Instead, prices would rise gradually as supplies are removed from normal markets and land instead in US Department of Agriculture storage facilities.

With supplies more scarce in normal marketing channels, some milk distributors and dairy product manufacturers could have turned to imported supplies.

The Department of Agriculture is reviewing a range of options for administering programs should a permanent law become legally effective on Jan. 1, a spokesman said on Friday.

The?Senate?passed its new five-year farm bill in June, and the?House Agriculture Committee?followed with a version in July.

But the?House?bill, with large cuts in food-stamp funding for lower-income Americans, has never been brought to a vote by the full?House. The?Senate?and?House?have for months remained far apart on the issues of food stamps and crop subsidies.

Lucas said the year-long extension "provides certainty to our producers and critical disaster assistance to those affected by record drought conditions."

It would also mean another round of the direct subsidies to farmers that cost about $5 billion a year, and that both sides of debate had agreed earlier to eliminate.

Toyota settlement will top $1 billion

6 hrs.

Toyota Motor Corp. has agreed to pay as much as $1.4 billion to settle U.S. litigation claims that its vehicles suddenly and unintentionally accelerated, according to court filings made public Wednesday.

The company said the deal will resolve hundreds of lawsuits from Toyota owners who said the value of their cars and trucks plummeted after a series of recalls stemming from claims that Toyota vehicles accelerated unintentionally.

Steve Berman, a lawyer representing Toyota owners, said the settlement is the largest in U.S. history involving automobile defects.

"We kept fighting and fighting and we secured what we think was a good settlement given the risks of this litigation," Berman told The Associated Press.

The proposed deal was filed Wednesday and must receive the approval of U.S. District Judge James Selna, who was expected to review the settlement Friday.

Toyota said it will take a one-time, $1.1 billion pre-tax charge against earnings to cover the estimated costs of the settlement. Berman said the total value of the deal is between $1.2 billion and $1.4 billion.

Hundreds of lawsuits have been filed against Toyota since 2009, when the Japanese automaker started receiving numerous complaints that its cars accelerated on their own, causing crashes, injuries and even deaths.

The cases were consolidated in U.S. District Court in Santa Ana and divided into two categories: economic loss and wrongful death. Claims by people who seek compensation for injury and death due to sudden acceleration are not part of the settlement; the first trial involving those suits is scheduled for February.

The deal includes direct payments to customers as well as the installation of a brake override system in about 3.25 million vehicles, plaintiff attorneys said.?The terms also?include a $250 million fund for former Toyota owners who sold vehicles at reduced prices because of bad publicity, and a separate $250 million fund for owners not eligible for the brake override system.

The settlement would also establish additional driver education programs and fund new research into advanced safety technologies.

"In keeping with our core principles, we have structured this agreement in ways that work to put our customers first and demonstrate that they can count on Toyota to stand behind our vehicles," said Christopher? Reynolds, Toyota vice president and general counsel.

Current and former Toyota owners are expected to receive more information about the settlement in the coming months. Some information is also available at http://www.ToyotaELsettlement.com, a website created for Toyota owners affected by the settlement.

"We are extraordinarily proud of how we were able to represent the interests of Toyota owners, and believe this settlement is both comprehensive in its scope and fair in compensation," Berman said.

Toyota has recalled more than 14 million vehicles worldwide due to acceleration problems in several models and brake defects with the Prius hybrid. Toyota has blamed driver error, faulty floor mats and sticky accelerator pedals for the unintended acceleration.

Plaintiffs' attorneys have spent the past two years deposing Toyota employees, poring over thousands of documents and reviewing software code, but the company maintains those lawyers have been unable to prove that a design defect ? namely Toyota's electronic throttle control system ? was responsible for vehicles surging unexpectedly.

Both the National Highway Traffic Safety Administration and NASA were unable to find any defects in Toyota's source code that could cause problems.

The company has been dogged by fines for not reporting problems in a timely manner.

Earlier this month, NHTSA doled out a record $17.4 million fine to Toyota for failing to quickly report floor mat problems with some of its Lexus models. Toyota paid a total of $48.8 million in fines for three violations in 2010.

Toyota President Akio Toyoda appeared before Congress last year and pledged to strengthen quality control. Recent sales figures show the company appears to have rebounded following its safety issues.

Information from the Associated Press and Reuters was included in this report.

5 Benefits of Earning Your Yoga Fitness Instructor Certification

The art and discipline of yoga boasts a rich history that dates back centuries. This age-old craft began in India, but has traveled across the globe, helping people get in touch with their inner spirits and achieve a higher level of fitness on an international level. The task of earning a yoga fitness instructor certification is a long one, but the rewards are far reaching. We have five benefits to look forward to when you obtain your yoga fitness instructor certification.

More People Practicing Yoga

According to some statistics, as many as 7.5 percent of adults in the United States now practice yoga regularly. An additional seven percent said they plan to begin a yoga program in the near future. With more adults and youth taking up yoga all the time, the opportunities to teach this discipline increase as well.

Job Opportunities Await
Yoga is an attractive fitness option to many demographics within the population, including children, pregnant women and seniors. With the ability to specialize in a particular sect of the population, you can customize your career to your own preferences and the needs of the local community. You can also opt to work in a gym, studio or even out of your own home.

Job Freedom and Flexibility

Yoga instructors can typically determine the days and hours they will conduct classes. This allows you to customize your career so that it fits with other demands in your life, like a second job or family responsibilities. Few jobs today allow you to work when and as much as you want. Your yoga fitness instructor certification opens the door to a flexible, rewarding career.

Sharing Your Passion with Others
Most people who pursue yoga fitness instructor certification begin as passionate students of the discipline. By earning their instructor certification, they can share that passion for yoga with others on a daily basis. Just imagine the joy of going to a job you love every single day. Most yoga instructors would agree that is what they do for a living.

Creating Relationships through Service
The art of yoga is all about service, and what better way to serve others than with your yoga fitness instructor certification. By sharing your love of yoga with others, you can develop deep relationships with others in your classes. These relationships may even result in the creation of new yoga instructors for the industry, as other students learn to share their passion by teaching others.

Obtaining your yoga fitness instructor certification is the first step on the road to a rewarding and lucrative career. Most yoga instructors begin as students, where they develop a passion for their craft and an appreciation for the many health benefits yoga provides. From there, future teachers can take their passion to the next level, with the appropriate training and certification that allows them to share their interest in yoga with others. There are many good yoga fitness instructor certification programs available today, ensuring you can find a program to jumpstart your career in the fitness field.

Male Peacocks Get Laid By Getting Laid

Duke University has studied the mating habits of peacocks to find out the logic behind why males make a noise called a "hoot dash" before they, you know, do it. And the reason turns out to be pretty funny: The best way for a dude peacock to attract a lady peacock is to first fornicate with another peacock and make the honking call. More »

NIBIQ?: a Surface-like keyboard case for your iPad

nibiqu kickstarter

Despite lackluster sales, Microsoft?s new Surface has been praised for its innovations. Windows 8 RT certainly doesn?t look like anything else on the market right now, and the tablet?s ultra-slim Touch Cover keyboard is an interesting concept.

In fact, a lot of folks are asking if there is something similar available for the iPad. There are, actually several keyboard covers that are compatible with Apple?s tablet, but none of them come closer to the Touch Cover than the?NIBIQ??

The?NIBIQ? is a super thin ? 3.55mm thin ? cover for your iPad made out of?TPU, polyurethane and aluminum. And it has a built-in 78-key keyboard with patent-pending?dual curvature thermoformed membrane tech for type feedback.

In addition to the keyboard, the NIBIQ?acts as a stand, allowing you to position your iPad in any inclination between 50 to 90 degrees. It also has built-in magnets, so?you can attach the case to your iPad in either portrait or landscape mode.

Communication between the keyboard and your tablet is handled by an L-shaped adapter that plugs into your iPad 2 or 3 (they say they?re almost done with Lightning adapters). The connection is wireless and doesn?t require any batteries.

The NIBIQ? is ready to start mass production, and the developers are hoping to raise $100k via a Kickstarter project to make it happen. If you?re interested, a pledge of just $89 puts you on the pre-order list for special edition green one.

I?ve gone all in on the iPad mini, so this doesn?t particularly appeal to me. But if I did more tedious work on a larger tablet, I?d be very interested in trying one out. Kudos to these guys for going against the grain here.

What do you think of the?NIBIQ??

Time series of infrared NASA images show Cyclone Evan's decline

Cyclone Evan is now far south of Fiji and wind shear and cooler sea surface temperatures have been taking their toll on the storm and weakening it. Infrared data from NASA's Aqua satellite has shown a quick decline in the storm's structure over one day.

A time series of infrared images from the Atmospheric Infrared Sounder (AIRS) instrument that flies aboard NASA's Aqua satellite showed changes in intense thunderstorms within Cyclone Evan between Dec. 18 and Dec. 19. Over a time period of 36 hours, Evan weakened from Cyclone strength to Tropical Storm strength. In an AIRS image captured on Dec. 18 there were two large areas of strong thunderstorms with very cold cloud top temperatures colder than -63 Fahrenheit (-52 Celsius).

By Dec. 19 at 0159 UTC (Dec. 18 at 8:59 p.m. EST/U.S.) the area of strong thunderstorms had become smaller, and the storm appeared less organized. In the AIRS infrared image from Dec. 19 at 1259 UTC (7:59 a.m. EST), the area of strongest thunderstorms had been reduced further and cloud top temperatures throughout the storm were warming, indicating cloud heights were falling because of less evaporation. Evan had moved over sea surface temperatures below the 80 degree Fahrenheit (26.6 degree Celsius) threshold, so evaporation and thunderstorm development had waned.

Wind shear had increased as well, pushing the bulk of the thunderstorm activity about 65 nautical miles (74.8 miles/120.4 km) to the southeast, according to the Joint Typhoon Warning Center. Northwesterly wind shear was very strong, blowing between 40 and 50 knots (46 and 57.5 mph/74 and 92.6 kph). Animated multi-spectral satellite imagery also showed the low-level circulation center remains fully exposed.

On Dec. 19 at 0900 UTC (4 a.m. EST/U.S.), Evan was a tropical storm with maximum sustained winds near 45 knots (51.7 mph/83.3 kph). It was located about 335 nautical miles (385.5 miles/620.4 km) south of Nadi, Fiji, near 23.7 south latitude and 178.3 east longitude. Evan was moving to the south-southeast at 7 knots (8 mph/13 kph).

Forecasters at the Joint Typhoon Warning Center noted that because of the strong wind shear and cooler sea surface temperatures, Evan may dissipate sometime on Dec. 20.

Cyclone Evan is now far south of Fiji and wind shear and cooler sea surface temperatures have been taking their toll on the storm and weakening it. Infrared data from NASA's Aqua satellite has shown a quick decline in the storm's structure over one day.

The president's response to Boehner's fiscal cliff proposal could be the one

This Nov. 16, 2012 file photo shows President Barack Obama, accompanied by House Speaker John Boehner of Ohio, speaking to reporters in the Roosevelt Room of the White House in Washington.

Associated Press

WASHINGTON ? Just two weeks before the economy-threatening "fiscal cliff" is due to kick in, both President Barack Obama and House Speaker John Boehner are making significant concessions to each other, backing off what had once been ironclad positions on how to avoid the huge automatic spending cuts and tax increases.

The moves signal a new stage in the negotiations, which picked up steam Monday with Obama's offer to drop his long-held insistence that taxes rise on individuals earning more than $200,000 and families making more than $250,000. He is now offering a new threshold of $400,000 and lowering his 10-year tax revenue goals from the $1.6 trillion he had argued for a few weeks ago.

Obama's move follows concessions by Boehner on higher tax rates for the wealthy.

In the new proposal, Obama abandoned his demand for permanent borrowing authority. Instead, he is now asking for a new debt limit that would last two years, putting its renewal beyond the politics of a 2014 midterm election.

And in a move sure to create heartburn among some congressional Democrats, Obama is proposing lower cost-of-living increases for Social Security beneficiaries, employing an inflation index that would have far-reaching consequences, including pushing more people into higher income tax brackets.

Those changes, as well as Obama's decision not to seek an extension of a temporary payroll tax cut, would force higher tax payments on the middle class, a wide swath of the population that Obama has repeatedly said he wanted to protect from tax increases.

As public posturing has given way to pragmatism, both sides still seem willing to lock in on a substantial agreement rather than just putting off a fiscal day of reckoning. To that end, Obama has conceded that a big bargain would require giving up some of his proposals.

"I understand that I don't expect the Republicans simply to adopt my budget," he said during his post-election news conference last month. "That's not realistic. So, I recognize we're going to have to compromise."

The talks, facing a looming deadline, seek to avoid across-the-board tax hikes for nearly all wage-earners as well as spending cuts at the Pentagon and in domestic programs that are set to kick in at the start of the new year. Economists inside and outside the government have warned that the combination of the two ? the "fiscal cliff" ? could stall a weak recovery and threaten a new recession.

Obama's steps toward Boehner came after the House speaker took a plunge in a call to Obama on Friday ? while the nation was focused on the horror of a mass murder in Newtown, Conn. ? and agreed to accept an increase in tax rates for taxpayers who earn more than $1 million. Boehner's plan would raise about $1 trillion in taxes over 10 years.

That was a barrier-breaking moment, changing the negotiations from a fundamental debate over whether tax rates should rise at all to quibbling over who should pay them.

There are still plenty of disputes to iron out. And people familiar with Obama's proposal were careful not to describe it as his final offer.

The Obama plan seeks $1.2 trillion in revenue over 10 years and $1.2 trillion in 10-year spending reductions. Boehner aides say the revenue is closer to $1.3 trillion if revenue triggered by the new inflation index is counted, and they say the spending reductions are closer to $930 billion if one discounts about $290 billion in lower estimated debt interest.

"Any movement away from the unrealistic offers the President has made previously is a step in the right direction," Boehner spokesman Brendan Buck said. "But a proposal that includes $1.3 trillion in revenue for only $930 billion in spending cuts cannot be considered balanced."

Either way, though, there is no doubt Obama has moved in Boehner's direction after Boehner opened the door to a tax rate increase.

49ers hold off Patriots on SNF

New England erases 31-3 San Francisco lead, but loses 41-34

NBC Sports

updated 12:10 a.m. ET Dec. 17, 2012

FOXBOROUGH, Mass. - Jim Harbaugh might have learned more about his San Francisco 49ers during 20 minutes of sleepwalking than at any other time in his two years as their coach.

His 49ers turned a nearly historic collapse into a stunning victory and a playoff berth. They withstood a 28-point comeback by the New England Patriots to win 41-34 on Sunday night in the rain.

"Our team has now hung in in a lot of big-time pressure games," Harbaugh said. "They've overcome adversity. They've shown they can do that."

Michael Crabtree took a short pass from Colin Kaepernick and sped around cornerback Kyle Arrington for a 38-yard touchdown with 6:25 to go, then David Akers made a 28-yard field goal to clinch it.

"We can win a shootout," Crabtree said. "Whatever it takes, that's our motto. ... We feel like we can do anything, sky's the limit."

The 49ers (10-3-1) own at least a wild-card spot and play at Seattle next week with a chance to win the NFC West. A loss would bring the division race down to the final weekend.

Kaepernick threw for four touchdowns, two to Crabtree, who had 107 yards receiving. The defense rattled Tom Brady at times, but also yielded 443 yards passing in a sloppy contest between two of the league's more precise teams.

AFC East champion New England (10-4), which had won seven in a row, trailed 31-3 in the third quarter and lost for the first time at home in December in 21 games. The Patriots also had won 21 in a row in the second half of the schedule before San Francisco somehow regrouped late in a game it seemingly had clinched long before.

"I used to live next to a train station in Chicago," Harbaugh said. "And it's like the more you hear the train, the less you hear it. I feel that way with our team in terms of pressure in big games. The more you feel it, the less you feel it."

San Francisco forced four turnovers, matching the number of giveaways New England had at home all season.

But then the Niners began collapsing, and back came Brady and the Patriots on a 6-yard TD run by Danny Woodhead and a 1-yard dive by Brady. A 5-yard pass to Aaron Hernandez and Woodhead's 1-yard run with 6:43 remaining tied it.

And just like that, San Francisco went in front again.

Rookie LaMichael James broke free for a 62-yard kickoff return. On the next snap - the third time the Niners would have a one-play TD drive - Crabtree took a pass on the left side, spun and headed into the end zone.

"We faced adversity," James said. "Nobody flinched."

New England turned over the ball on downs and Akers made his kick. Stephen Gostkowski added a 41-yarder for the Patriots with 38 seconds remaining, but they couldn't recover the onside kick.

San Francisco led 17-3 at the half. And they looked safe after Frank Gore picked up Kaepernick's third fumble and scored on a 9-yard run, followed by Crabtree's 27-yard score in a pinpoint pass from the second-year quarterback.

The defense set up both of San Francisco's TDs in the third.

Dashon Goldson returned Steven Ridley's fumble 66 yards to the New England 3 before Gore found the end zone. Defensive end Aldon Smith, known for his sacks, grabbed a pass out of Hernandez's hands for his first career interception. After he was tackled, Smith ran directly to the sideline and sat down on the 49ers' bench.

He was back up on his feet cheering the next play, when Crabtree broke free to make it 31-3.

"We just spotted them 28 points," Brady said. "We fought hard, but you can't play poorly against a good team and expect to win. We can't miss plays that we have opportunities with."

Still, no one can relax against the Patriots.

Unlike a week ago, when the Patriots routed Houston, they fell behind quickly in the rain and ran only 10 snaps on their opening three series. San Francisco's fearsome pass rush was sharp then, and Brady was hit on the arm twice while trying to pass.

Even worse, his long throw on their third possession for Wes Welker was picked off by Carlos Rogers, who then slalomed his way on the wet turf toward the New England end zone. Only Brady stood in his way at the 5, and Rogers fell trying to elude him.

It was a key stop because Delanie Walker fumbled two plays later.

Earlier, Kaepernick accounted for 60 yards through the air on the 49ers' first drive. Randy Moss showed the kind of elusiveness that made him a record-setter in New England from 2007 until he was traded early in the 2010 by getting behind the secondary for a 24-yard TD.

His short celebration as he faced the crowd drew loud hoots.

Brady preventing Rogers from scoring was about the only highlight for the Patriots in the opening quarter, but the 49ers weren't any more effective beyond their scoring drive and a 38-yard run by Goldson on a fake punt. The slopfest included Akers' being wide left on a 39-yard field goal.

All this from teams ranked 1-2 in fewest giveaways.

"We just didn't even give ourselves a chance," Brady said.

When the Patriots finally got their usually unstoppable offense going, they used 16 plays and converted a fourth down. But they stumbled inside the 10 when Brady was sacked by Ray McDonald. Gostkowski made a 32-yard field goal.

San Francisco answered quickly, helped by a 35-yard pass interference call on Aqib Talib. Walker slipped behind a zone defense for a 34-yard TD pass from Kaepernick, making it 14-3.

Akers made a 20-yard field goal as the half ended, finishing a 15-play, 76-yard drive. The three points were the Patriots' fewest in a half all season, and they were outgained 249-113.

Of course, that turned around in the second half.

Aside from the players' mistakes, the game also was slowed by officiating confusion that led to several lengthy conferences. One delay took about 10 minutes to decide whether 49ers punt returner Ted Ginn Jr., muffed a second-quarter kick.

NOTES: Welker now has 100 catches this season, the fifth time he has reached that number, an NFL record. ... New England has 506 points, the fourth time it has reached 500, also a league mark. ... San Francisco had allowed only 184 points going into the game, lowest in the league. ... Andy Lee averaged 54 yards net on five punts for the 49ers. ... Brady's 65 throws are a career high. ... Brandon Lloyd had 10 catches for 190 yards for New England.

United Continental pilots ratify new contract

(Reuters) - Pilots at United Continental Holdings, the world's biggest airline, have ratified a contract with the U.S. carrier that will provide enhanced pay and retirement plan contributions, their union said on Saturday.

The tentative agreement was approved by 67 percent of voting pilots, the Air Line Pilots Association (ALPA) said in a statement. Some 98 percent of the eligible 10,193 pilots participated in the voting, which ran from December 1 through Saturday.

The contract provides benefits such as a lump-sum payment that averages about $40,000 per pilot, and 16 percent company contribution to pilots' defined contribution plan, the union said.

ALPA represents more than 12,000 United Continental pilots.

The agreement was reached after more than two years of negotiating for a joint collective bargaining agreement with United Continental, which was formed when United parent UAL Corp and Continental Airlines merged in 2010.

The contract approval removes a hurdle to fully integrating the combined company and creating a single workforce.

Union leaders said when the agreement was initially reached that it would help make economic amends to pilots who had made concessions during difficult years for the airline industry.

Pilots at United and Continental have been working without new contracts since they agreed to givebacks in the last decade, during which time United went into bankruptcy and Continental took stringent cost-cutting measures.

Make your point calmly and quietly ? Business Management Daily ...

It?s easy to become frustrated at work, but yelling won?t help you get your point across. Instead of screaming, use a calm tone and focus on the situation at hand, recommends Amy Levin-Epstein in Forbes.com. Some other tips for resolving problems in a productive way:

  • Get informed. Make sure you understand the details of the situation before you jump into the fray.
  • Mind your body language. Certain nonverbal cues, such as leaning forward while conversing, can show that you are invested in the discussion.
  • Location, location, location. In general, it?s best to pick a private spot to discuss touchy topics. This will allow supervisors and employees to speak frankly about the problem without causing embarrassment.
